Data licence terms

This document is an offer to enter into a licence agreement on the terms set out below. Paying the invoice on the Data licensing page means acceptance of these terms.

1. Subject

The seller grants the buyer (the licensee) a non-exclusive right to use the values of TradeAlmanac indicators — our own calculations on a 0 to 100 scale — within the limits and for the term set by these terms. The licence covers the indicators served by the keyed programming interface; the freshness report address lists them. Indicators closed to machine distribution by the terms of their sources are not part of the licence.

2. What is allowed

• Using indicator values and history in your own products and services, including paid ones: on a site, in an app, in a newsletter, in client reports.
• Showing the values to your users and building charts and derived figures from them.
• Placing the indicator widget without a link to our site by putting the licence number into the widget address.
• Storing the values you received and, after the licence ends, keeping them in materials published while it was in force.

3. What is not allowed

• Reselling indicator values as a separate service or feed, or passing the right of use to third parties.
• Passing the key to third parties. The licence number is not a secret, but only the licensee may use it, on the licensee's own properties.
• Presenting the indicators as exchange information, as the licensee's own methodology or as investment advice.
• Removing the date of the value from the widget or otherwise presenting a stale value as fresh.
• Circumventing the rate limit and the daily quota, including by taking several licences for one party and one product.

4. Price and payment

The price and the available terms are stated on the Data licensing page in Russian roubles and apply at the moment of payment. Payment is made in advance through a payment agent, by bank card or the Faster Payments System. The seller is on the Russian professional income tax regime, so no cash register is used and no VAT invoice is issued: for each payment the seller issues a receipt in the “Moy Nalog” service under Federal Law No. 422-FZ, with the buyer's name and tax number if they were given at payment. The link to the receipt is placed in the buyer's order.

5. How access is provided

Access is provided electronically. Once the payment agent confirms the payment, the licence is activated automatically, usually within a few minutes. The API key is issued on the licensing page in the buyer's account and is shown once; a lost key is reissued in the same place, and the previous one is revoked. The licence number for the widget is shown in the order.

If the licence has not been activated within an hour of the charge, write to us at the address in Contacts. We will activate it manually or refund the payment in full.

6. Term and renewal

The licence term is 30 or 365 days from the moment of payment, at the buyer's choice. There are no automatic charges. A renewal is paid separately and is added to the remaining term: paid days are not lost, and the licence number and the key stay the same. When the term ends, the key stops working and a widget carrying the licence number shows the link to our site again.

7. Data update times

Indicator values are updated on the schedule of the background calculation. Target update times are published on the Data licensing page; the freshness report gives the actual date and age of every value. If an indicator value stays older than its target for more than three consecutive days through the seller's fault, the licence term is extended by the number of days of that delay at the buyer's request. The seller does not guarantee availability of the interface at every moment.

8. Refunds

The buyer may withdraw from the licence within 14 calendar days of payment: the payment is refunded in full, the licence ends and the key is revoked. The request is sent to the address in Contacts and is reviewed within 10 calendar days. The refund is made by the same method as the payment; the crediting time depends on the bank and is usually one to ten business days.

9. Liability and changes to the terms

TradeAlmanac does not provide investment advisory services and gives no individual investment recommendations. The indicators are provided as is: they are calculations on data from open sources, which may contain inaccuracies or arrive with a delay. Decisions based on the indicators are made by the licensee and its users on their own. The seller's liability is limited to the amount paid for the current licence term.

The seller may change these terms and the price. A paid term is governed by the terms and the price published at the moment of payment; new ones apply from the next renewal. An indicator's methodology may change: every version of the methodology is published, and the values of earlier versions remain in the history.
